Terms of use

1. Who these terms are with

DiagramDesk is operated by Inyonitech Solutions (Pty) Ltd, registered in South Africa. Using the site means you accept these terms. If you do not accept them, please do not use the site.

2. What the site is

A free diagram editor that runs in your browser. There is no account, no subscription and nothing to pay. The site carries no advertising at present; the intention is to fund it with adverts on the pages around the editor.

3. What you draw is yours

You keep every right in the diagrams you make. We claim no licence over them and never see them, because they stay on your device. You may use what you draw for anything, including commercial work, with no attribution.

You are responsible for what you put in a diagram, including any material belonging to somebody else that you place on the canvas.

4. Your work is not backed up

Diagrams live in your browser's storage. That storage can be cleared by you, by your browser, by a privacy setting, by a cleanup tool, or by using a private window. If it is cleared, the work is gone and we cannot recover it, because we never had it.

Export anything you would be sorry to lose. Use Export and save a file. We accept no responsibility for work lost from browser storage.

5. Fair use of the site

You agree not to:

• use the site to do anything unlawful, or to help somebody else do so;
• try to break, overload or gain unauthorised access to the site or its hosting;
• republish the site itself as your own service;
• interfere with any adverts, or encourage anyone to click them artificially.

6. Availability

The site is provided as it is and as it happens to be available. We may change it, take features away, or stop running it, at any time and without notice. It is free, and no uptime is promised.

7. No warranty

To the extent the law allows, the site comes with no warranty of any kind. We do not promise it is free of faults, that it will suit a particular purpose, or that a diagram drawn here is correct for whatever you need it for. Diagrams describing a process, a system or a policy are your work and your responsibility, not advice from us.

8. Liability

To the extent the law allows, we are not liable for lost work, lost profit, lost time or any indirect loss arising from using the site. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

If you use the site as a consumer, the rights your own national consumer law gives you are not affected by anything here, including under the Consumer Protection Act in South Africa.

9. Third-party links and adverts

Any adverts are supplied by Google and we do not choose or check what appears. Links to other sites are for convenience and are not an endorsement. What happens on another site is governed by that site's terms.

10. Trademarks and other people's marks

UML and BPMN are marks of the Object Management Group. Any other product or company name on this site is named only to say what it is. All marks belong to their owners, and this site is not affiliated with, endorsed by or connected to any of them.

11. What you send us

If you email a suggestion — a shape, a template, a correction — you are giving us permission to act on it and to build it into the site, with no obligation on either side and no payment. You keep whatever rights you had in it. Please do not send anything confidential or anything belonging to somebody else.

12. Changes

We may update these terms. The date at the top changes when we do. Continuing to use the site after a change means you accept the new version.

13. Governing law

These terms are governed by the law of South Africa, and the courts of South Africa have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory laws of the country you live in.
